Probate

GUARDIANSHIP
A person who is not able to make sound decisions about his or her person and/or property can be protected by a guardianship. Guardianship is a legal proceeding in the circuit court of Florida and begins with a determination of the individuals capacity, or lack thereof. If an individual has been adjudicated as incapacitated, or lacking the capacity to care for himself or herself and his or her affairs, a guardian is appointed by the court. Minerva Vazquez Bailey is a bilingual native to South Florida. She attended St. Thomas University for her undergraduate degree and graduated from Nova Southeastern University with her Juris Doctorate degree in 1999. Minerva Vazquez Bailey began her career as a paralegal before becoming an attorney. As a Cuban-American, she is fluent in both English and Spanish. She has been employed in the legal field for her entire career and has been focusing on the legal needs of families with special needs children since she started advocating for her children. Shortly after entering the practice of law, her two sons were diagnosed with developmental disabilities. While continuing to assist non-disabled families with their estate planning and probate needs, Minerva expanded her practice to include special needs planning, guardianship and less restrictive alternatives, preservation of government benefits, long term care planning and advocating for persons with disabilities, as well as seniors.
Minerva is a member of National Academy of Elder Law Attorneys (NAELA), Academy of Florida Elder Law Attorneys (AFELA), North Dade South Broward Estate Planning Council, Broward Coalition on Aging, and Florida State Guardianship Association. Minerva is also an active Board Member for the Advocacy Center for Persons with Disabilities.
